Elkhorn Public Schools Negotiated Agreement

As part of the application and agreement for the program, an authorized employee who chooses to participate in the Elkhorn Public School District must enter into the following waiver and downgrade: „By entering into this agreement, the authorized employee releases, renounces, releases and forever dismisses the school district, current and future members of the board of education of such a school district in their official and individual duties, the directors and all senior officers, agents and collaborators of the school district in their official and individual capacity, of all claims, whatever they may be, whether for damages, costs, expenses, compensation, penalties, salaries, benefits, reinstatement, attorneys` fees, or attorneys` fees, less than 42 us.C. „1988 or otherwise, with respect to the employment or employment of the licensed worker in the school district, including, but not limited to, rights or entitlements: (2) Higher wage: if two (2) or more are filed on the same day, it is the person or persons with the highest wages in the agreement negotiated between the school district and the Elkhorn Education Association, or its successor, valid for the contractual year in which the applications are received, participation in the ERIP EP is privileged. This waiver and release is made in exchange for a good and valuable consideration (the ERIP severance pay) that goes beyond what the authorized employee is otherwise entitled to under the law or agreement. „Prior to mediation, no less than four bargaining meetings shall be held between the collective agreement representative of the certified delegate and the lecturer and the negotiator of the board of directors, unless the parties agree on a new negotiated agreement. Either party may request a bargaining order in accordance with the law at any stage of the negotiation. When requesting a negotiating mandate, the Commission shall communicate to the parties the names of five persons qualified for the position of resolution officer. If the parties are unable to agree on a person, each party must, in turn, delete names, with the remaining person acting as resolution officer. 4. 5. Acceptance or Rejection of Applications: The Education Committee of the School District reserves, at its own discretion, the right to accept or reject certain applications due to financial requirements, availability of resources, budget, expenditures, revenues and other school funding matters. The Elkhorn Public School District ERIP is only offered to authorized employees as defined herein, who submit an ERIP application and an agreement in a timely manner. The wage plan and benefits are discussed and amended as part of the collective bargaining process with licensed bargaining units. The remuneration and performance conditions set out in a duly ratified negotiated agreement between the Governing Board and a recognised bargaining unit must be respected.
